Privacy Policy

This policy describes how Pinch Med, Inc. ("Pinch," "we," "us," or "our") collects data, treats data, what we do, and what options you have regarding the collection and use of your data. Pinch Med, Inc. is a management services organization. It operates the Pinch websites described in the Scope section below and provides administrative, technology, and marketing support to the affiliated professional entities (for example, Pinch Med IL, P.C.) through which licensed clinicians deliver in-person aesthetic and wellness services. For this Privacy Policy, "you" and "your" means you as the user. Please note that our Services are designed for users in the United States only and are not intended for users outside the United States, or for anyone under the age of 18.

Scope of This Privacy Policy

This Privacy Policy applies to bookpinch.com, our skincare store at shop.bookpinch.com, any Pinch mobile application we make available, and the Pinch-branded pages of our telehealth program, which are hosted at rx.bookpinch.com, rxintake.bookpinch.com, and care.bookpinch.com (together, the "Telehealth Sites"). Together, these are our "Services."

Our telehealth program (the "Telehealth Program") is delivered through an independent, third-party telehealth platform provider (the "Telehealth Platform Provider"). The Telehealth Platform Provider operates the technology behind the Telehealth Sites, acts as the merchant of record for Telehealth Program purchases, and contracts with independent, licensed medical practices (the "Telehealth Medical Practices") whose clinicians evaluate patients and prescribe medications, and with licensed pharmacies (the "Telehealth Pharmacies") that fill and ship prescriptions. Pinch and its affiliated professional entities do not provide clinical or pharmacy services through the Telehealth Program, and Pinch's in-person clinicians do not prescribe Telehealth Program medications.

The Telehealth Platform Provider provides its own terms of service and privacy policies directly to users of the telehealth service. Those documents govern information collected and used by the Telehealth Platform Provider, the Telehealth Medical Practices, and the Telehealth Pharmacies, including your telehealth medical record, prescriptions, and payment information. This Privacy Policy governs Pinch's own collection and use of information across the Services, including the Pinch-branded portions of the Telehealth Sites. Please read both. This Privacy Policy, our Terms of Use, and our Notice of Privacy Practices are linked at the bottom of every page of the Services, including shop.bookpinch.com and the Telehealth Sites.

Information We Collect

We may collect different types of information during your interactions with our site and through our advertising and media across the Internet and our web and mobile apps. Some features of the Services may require you to directly enter certain information about yourself. You may elect not to provide this information, but doing so may prevent you from using or accessing certain of our Services. This information may include personal information (e.g., name, phone number, postal address, email address, and certain payment information), technical information (e.g., device identifier, IP address, browser type, operating system) and usage information (e.g., how you use and navigate to and from our site, and information about content). We may combine these types of information together, and collectively refer to all of this information in this Privacy Policy as "Information."

Information may be collected as described below and through the use of cookies, web beacons, pixels, SDKs, and other similar technologies by us or by other companies on our behalf. Below we describe the types of Information we may collect:

Aggregated information

We may collect, aggregate and anonymize non-personally identifiable information into statistics regarding user behavior such as overall patterns or demographic reports that do not describe or identify any individual user.

Registration information

We may collect Information in the course of your use of, or registration with, our site. For example, when you create an account, register for or download an app, or sign up for a product or service, you may provide us with certain personal information. This type of personal information may include name, phone number, postal address, email address, or certain payment information (e.g., credit card and billing information). We may also collect Information about your interest in and use of various products, programs, services, and content available on or through our site.

Health and screening information for in-person services

When you book an in-person service, you complete a health and safety assessment, medical history, and consent forms so that the clinician can determine whether a treatment is appropriate for you. This information, and the treatment records and clinical photographs the clinician creates during your visit, are maintained by our affiliated professional entities as part of your medical record and are addressed in the "Protected Health Information" and "Consumer Health Data" sections below.

Information collected through the Telehealth Program

When you use the Pinch-branded pages of the Telehealth Sites, you may provide account and contact information; your answers to a short eligibility assessment (for example, your state of residence, age range, height and weight, and the program category you are interested in); a referral or promotional code and the name of the Pinch clinician who referred you; and payment information. Once you proceed to the telehealth intake, medical history, consultation, and checkout, the information you provide is collected by the Telehealth Platform Provider and the Telehealth Medical Practices and is governed by the terms of service and privacy policies they provide to you directly. Pinch does not host your telehealth medical record.

We receive certain information back from the Telehealth Platform Provider so that we can administer the Telehealth Program, provide non-clinical customer support, pay referral compensation to Pinch clinicians, measure how the program is performing, and coordinate your care. This may include your name and contact information; whether you have an active enrollment and in which program category (for example, weight management, metabolic health, or skin care); order, shipment, subscription, and billing status; the referral code used; and, to the extent permitted by law and with your authorization where required, limited treatment information such as the medication you have been prescribed, which we use so that your Pinch clinician can plan your in-person aesthetic care.

We share with the Telehealth Platform Provider the information it needs to create your telehealth account, route you to a clinician licensed in your state, process your order as merchant of record, and support you. This includes your name, email address, phone number, account identifier, referral code and referring clinician, and the assessment answers you enter on Pinch-branded pages.

Other information you provide

When you interact with our site, you may share other information about yourself by, for example, creating a profile, or filling out a survey or application. We may collect this type of sensitive information if you participate in surveys, focus groups, or opportunities to test new products, programs, or services. We collect this sensitive information with your consent, if required by law, and we take steps to protect and limit any use of it to the purposes for which it is provided.

Information from others; inviting friends

We may collect Information other people submit about you. For example, a friend might submit Information to invite you to participate in a joint service, make recommendations, or share content. By processing these requests, we may receive your Information, including a recipient's name, postal address, email address, telephone number, or information about your interest in and use of various products, programs, and services. Some portions of our site may also allow users to invite friends to participate in activities by providing their friends' contact details or importing contacts from your address book or from other sites.

Information from other sources

We may combine Information we receive online with other information, including usage information from our online advertising and media. We may also supplement or combine Information with information from a variety of other sources or outside records, such as demographic, transaction history, or personal information, and we may use that combined information in accordance with this Privacy Policy.

Information you provide through social media

You can engage with some of our content and offerings, such as videos, live feeds, apps, and other offerings on or through third party communities, forums, and social media sites, platforms, services, plug-ins, and applications ("Social Media Sites"). When you link to or interact with our site, content, or offerings through Social Media Sites, you may allow us to receive certain Information from your social media account (e.g., name, user ID, email address, profile photo, photos and videos, gender, birthday, location, your list of friends and their contact details, people you follow and/or who follow you, the posts or the 'likes' you make). We may also receive Information from your interaction with our content (e.g., content viewed, time spent on our site, etc.). By providing this Information or otherwise interacting with our site through Social Media Sites, you consent to our use of Information from the Social Media Sites in accordance with this Privacy Policy. For information about how you can customize your privacy settings on Social Media Sites, and how those Social Media Sites handle your personal information and content, please refer to their respective privacy help guides, privacy policies, and terms of use.

Location information

We may have access to certain Information about your location, such as your country or address, when you provide it either directly or via device information. If you access our site on your mobile device, we may collect Information about your device's precise location. We also may derive a general location from device information (such as an IP address).

Information you provide through camera access

For some features, we will ask for permission to access your device's camera. If you grant permission, you may be able to take pictures or video within the app experience. Other facial scanning technology may be used for research, analytics, and enhancing consumer experiences.

Technical and usage information

We also collect certain technical and usage information when you use our site, such as the type of device, browser, and operating system you are using, your Internet service provider or mobile carrier, unique device identifier, device and browser settings, the web pages and apps you use, and certain site usage information.

Protected Health Information (PHI)

In connection with the clinical services provided by our affiliated professional entities (e.g., Pinch Med IL, P.C.), health information about you, such as your medical history, intake and consent forms, treatment records, and clinical photographs, may be collected and maintained. That information is protected health information ("PHI") governed by our Notice of Privacy Practices, which describes how PHI may be used and disclosed, your rights regarding your health information (including the rights to inspect, copy, and amend your records and instructions on how to exercise those rights), how to file a complaint, and our legal duties to maintain the privacy and security of PHI. To the extent this Privacy Policy conflicts with the Notice of Privacy Practices with respect to PHI, the Notice of Privacy Practices controls. You may view our Notice of Privacy Practices at https://www.bookpinch.com/notice-of-privacy-practices.

Health information you provide through the Telehealth Program, including your telehealth intake, consultation, prescriptions, and pharmacy records, is protected health information held by the independent Telehealth Medical Practices and Telehealth Pharmacies. Their privacy policies, which they provide to you directly, govern that information. Our Notice of Privacy Practices does not apply to PHI created or maintained by the Telehealth Medical Practices or Telehealth Pharmacies, except to the extent our affiliated professional entities receive it to coordinate your care, in which case our Notice of Privacy Practices governs our copy.

Consumer Health Data

This section applies to "consumer health data" as defined under the Washington My Health My Data Act, the Nevada consumer health data law, the Connecticut Data Privacy Act, and similar state laws. It supplements the rest of this Privacy Policy. If any of this information is also PHI held by our affiliated professional entities, our Notice of Privacy Practices governs it.

What consumer health data we collect

Consumer health data is personal information that identifies your past, present, or future physical or mental health status. Depending on how you use the Services, we may collect the following categories: health and safety screening answers you provide when booking an in-person service, such as allergies, medical conditions, medications, and pregnancy or nursing status; treatment records and clinical photographs maintained by our affiliated professional entities; the eligibility assessment answers you provide on the Pinch-branded pages of the Telehealth Sites, such as height, weight, health goals, and state of residence; your Telehealth Program enrollment status and program category, and, where authorized, limited treatment information, received from the Telehealth Platform Provider; and inferences drawn from this information, such as which services may be appropriate for you.

Where it comes from

We collect consumer health data directly from you, from the clinicians engaged by our affiliated professional entities, and from the Telehealth Platform Provider as described above.

How we use it

We use consumer health data to provide the services you request; to determine whether a service is appropriate and safe for you; to coordinate your care between your in-person clinician and the Telehealth Program; to communicate with you about your appointments, treatments, and care; to process payments; and to comply with law. We do not use consumer health data for advertising without your consent, and we do not collect consumer health data that is not necessary to provide a service you have requested unless you consent.

Who we share it with

We share consumer health data only with: our affiliated professional entities (currently Pinch Med IL, P.C.) and the licensed clinicians they engage; the Telehealth Platform Provider, the Telehealth Medical Practices, and the Telehealth Pharmacies, when you use the Telehealth Program; service providers that host our scheduling and records systems, process payments, and deliver our email and text messages, under contracts that restrict their use of the data; and government authorities where required by law. A list of the affiliates and third parties with whom we have shared consumer health data is available on request. We do not sell consumer health data.

Your rights

You have the right to confirm whether we are collecting, sharing, or selling your consumer health data; to access it; to receive a list of the third parties and affiliates with whom we have shared it; to withdraw consent to our collection and sharing of it; and to have it deleted, including from our service providers and from anyone with whom we have shared it. We will not discriminate against you for exercising these rights. To exercise them, email privacy@bookpinch.com or write to us at the address in the Contact Us section. We may need to verify your identity before acting on a request. If we deny your request, you may appeal by replying to our decision or emailing privacy@bookpinch.com with "Appeal" in the subject line. If your appeal is denied, you may contact your state Attorney General; Washington residents may contact the Washington State Office of the Attorney General.

Information Use

We use Information for the purposes described in this policy or disclosed at the time of collection or with your consent.

Providing and marketing products and services

We may use the Information we collect about you through our site to fulfill your requests for, and otherwise provide or analyze your use of our products, programs, and content, to facilitate sharing and other interactions with Social Media Sites, and to provide, develop, maintain, personalize, protect, and improve your experience and our offerings. For example, we use Information we collect to enable you to do things like (i) get information about our products, services, and content, (ii) locate and access personalized information or functionality based on your interests or location, (iii) engage with interactive features, activities, and Social Media Sites, (iv) read and post comments, content, and reviews, (v) fill out surveys or provide feedback, or (vi) enter promotions and contests. We may also use Information to offer, market, and advertise products, programs, and services from us and our affiliates, business partners, and select third parties that we believe may be of interest to you.

Administering the Telehealth Program

We use the information described in "Information collected through the Telehealth Program" to hand you off to the Telehealth Platform Provider, to answer non-clinical questions about your account, billing, and shipping, to credit the Pinch clinician who referred you, to measure enrollment and retention, and, where authorized, to coordinate your in-person care with your telehealth care.

Communicating with you and others

We may use Information about you to communicate with you, such as (i) to notify you when we make changes to our policies or user agreements, (ii) to respond to your inquiries and provide you with customer service, (iii) to communicate with you about your purchases or transactions, (iv) to contact you about your account, or (v) to send you information about promotions, offerings, and site features. You may also choose to receive push notifications from us on your mobile device. If you choose to submit content for publication online or in other forums, we may publish your screen name or username and other Information you have provided to us on our site, the Internet, or elsewhere. We use Information that you provide about others to enable us to send them invitations, promotions, or other content on your behalf or through our site. From time to time, we also may use this Information to offer, market, or advertise products, programs, or services to them from us and our affiliates, and business partners.

Use of technical and usage information

We may use technical and usage information to improve the design, functionality and content of our site and to enable us to personalize your experience with our site and offerings. For example, we may use this Information (i) to provide, develop, maintain, personalize, protect, and improve our site, products, and services and to operate our business, (ii) to perform analytics, including to analyze and report on usage and performance of our site, (iii) to protect against, identify, and prevent fraud and other unlawful activity, (iv) to create aggregate data about groups or categories of our users or other demographics, and (v) for us and our affiliates, business partners, and select third parties to target, offer, market, or advertise products, or services.

Compliance

We may use Information we collect to detect, investigate, and prevent activities on our site that may violate our terms of use, could be fraudulent, violate copyright, or other rules or that may be otherwise illegal, to comply with legal requirements, and to protect our rights and the rights and safety of our users and others.

No Sale or Sharing of Personal Information

We do not sell, rent, lease, or trade your personal information for monetary compensation.

We also do not "share" personal information for cross-context behavioral advertising as defined under the California Consumer Privacy Act (CCPA), except where you have provided consent through our cookie preference tools.

To the extent any analytics or advertising technologies could be interpreted as a "sale" or "sharing" under certain state privacy laws, you may opt out at any time by using our "Do Not Sell or Share My Personal Information" link available in the footer of our websites.

Disclosure and Sharing of Information

In certain circumstances, we may disclose your Information to third parties for a business purpose. We do not sell, rent, lease, or "share" your Information, and will not disclose your Information to third parties for purposes of their direct marketing without providing notice to you.

With your consent

We may disclose Information when you provide us with your consent to do so.

With our affiliated professional entities

We share Information with the affiliated professional entities through which Pinch clinicians deliver in-person services, and with the licensed clinicians they engage, so that they can schedule, evaluate, and treat you and maintain your medical record.

With the Telehealth Platform Provider, the Telehealth Medical Practices, and the Telehealth Pharmacies

When you use the Telehealth Program, we share the information described in "Information collected through the Telehealth Program" with the Telehealth Platform Provider, which in turn makes it available to the Telehealth Medical Practices and Telehealth Pharmacies as needed to evaluate you, prescribe, fill, ship, bill, and support you. Their use of that information is governed by their own privacy policies.

Legal and law enforcement purposes

We may disclose Information in response to a legal process, for example in response to a court order or a subpoena, or in response to a law enforcement agency's request. We also may disclose such Information to third parties: (i) in connection with fraud prevention activities, (ii) where we believe it is necessary to investigate, prevent, or take action regarding illegal activities, (iii) in situations that may involve violations of our terms of use or other rules, (iv) to protect our rights and the rights and safety of others, and (v) as otherwise required by law.

Change of control

We may transfer Information in the event of a business transaction, such as if we or one of our business units or our relevant assets are acquired by, sold to, or merged with another company or as part of a bankruptcy proceeding or a business reorganization.

Service providers

Organizations that perform services for us may have access to Information to help carry out the services they are performing for us, such as, but not limited to, creation, maintenance, hosting, and delivery of our site, products, and services, scheduling and electronic records hosting, identity verification, email and text messaging, conduct marketing, handle payments, email and order fulfillment, administer promotions, conduct research and analytics, or customer service. The Telehealth Platform Provider is a service provider to Pinch for the non-clinical account, intake, and support functions it performs on our behalf.

With our Affiliates

We share your Information with our affiliates, subsidiaries, and other companies under common control and require them to honor this Privacy Policy as well.

With Payment Processors

We share your Information with our third-party payment processors, such as Stripe, for in-person services and purchases from our skincare store. Purchases through the Telehealth Program are processed by the Telehealth Platform Provider as merchant of record, and its name or descriptor, alone or co-listed with Pinch's, may appear on your card statement.

With Marketing, Advertising, and Analytics Service Providers

We may share Information about you with our data analytics and advertising service providers, such as Google Analytics, to help us measure traffic and usage trends. These companies may collect personal information when you interact with our digital property, including IP addresses, digital identifiers, information about your web browsing and app usage and how you interact with our properties and ads for a variety of purposes, such as personalization of offers or advertisements, analytics about how you engage with websites or ads and other commercial purposes.

Analytics and Advertising Technologies

We use third-party analytics and advertising service providers to help us understand how visitors use our websites, including shop.bookpinch.com and the Telehealth Sites, and to measure the effectiveness of our marketing efforts. These providers may include, but are not limited to:

  • Google Analytics and Google Tag Manager
  • Google Ads services
  • Meta (Facebook) advertising services
  • Customer.io
  • Content delivery networks such as Amazon CloudFront

These providers may collect certain information from your browser or device, including IP address, device and browser identifiers, referring URLs, pages visited, date and time of access, and interaction information.

This information may be considered "addressing" or "signaling" information used to facilitate communications between your device and our website and its service providers.

Where required by applicable law, such technologies are not activated until you provide your consent.

We configure analytics tools, where available, to support data minimization measures such as IP anonymization. We do not use your health and screening answers, telehealth intake responses, or treatment information for advertising, and we do not intentionally pass that information to advertising platforms.

Linked sites

Our site may contain links to other sites, including Social Media Sites, whose information practices may be different from ours. Information you submit to other sites will be governed by the other sites' privacy policies and terms.

To Protect Rights and Property

We may disclose your Information to third parties when we believe in good faith that disclosure is necessary to protect our rights, our property, personal safety, or the interests of you or any other person, and to detect, prevent and/or otherwise address fraud, risk management, security or technical issues.

Your Options and Control

Marketing communications and sharing with third parties

We provide you with an opportunity to express your preferences with respect to receiving certain marketing communications from us, and our sharing of personal information with unaffiliated third parties for their direct marketing purposes. If you ever decide in the future that you would like to update these preferences, you may contact us. To opt out of receiving our email marketing communications, you can also follow the "unsubscribe" instructions provided in any marketing email you receive from us. If you previously chose to receive push notifications on your mobile device from us, but no longer wish to receive them, you can manage your preferences through your device or app settings, depending on the type of device. If you have signed up to receive text messages from us and no longer wish to receive such messages, you may follow the instructions to stop the delivery of such messages, which may include by replying "STOP" to the received text message.

Ad Choices

On our own or working with affiliates or third parties, we may present advertisements and engage in data collection, reporting, ad delivery and response measurement, and site analytics on our site and on third party websites across the Internet and applications over time. We, our affiliates, or third parties may use cookies, web beacons, pixels, software development kits ("SDKs") or similar technologies to collect information across websites, services, and apps over time to perform this activity. We, our affiliates, or third parties may use and transfer this information in order to help serve advertising that may be more relevant to your interests on and off our site and across your devices and browsers. This type of advertising is known as interest-based advertising.

For more information about interest-based advertising on your desktop or mobile browser, and to opt out of this type of advertising by third parties that participate in self-regulatory programs, please visit the Network Advertising Initiative website and/or the Digital Advertising Alliance (DAA) Self-Regulatory Program for Online Behavioral Advertising website. To learn more about interest-based advertising in mobile apps and to opt out of this type of advertising by third parties that participate in the DAA's AppChoices tool, please use the version of AppChoices for your device.

Please note that any opt-out choice you exercise through these programs will apply to interest-based advertising by the third parties you select, but will still allow the collection of data for other purposes, including research, analytics, and internal operations.

To opt out of our own collection, use, and transfer of data as described above for interest-based advertising, please use the "Do Not Sell or Share My Personal Information" and "Cookie Preferences" links in the footer of our websites. Please note that if you opt out, we will continue to collect data for other purposes, including research, analytics, and internal operations.

Precise location information

To disable the collection of precise location information from your mobile device through our mobile apps, you can access your mobile device settings and choose to limit that collection.

Cookies and Associated Technologies

How we use cookies and similar technologies

We, and our affiliates, vendors, and business partners may send cookies to your computer or use similar technologies to understand and enhance your online experience at our site and through our advertising and media across the Internet and mobile apps.

Cookies are small text files placed in your browser. We may also use pixels or web beacons that monitor your use of our site. Web beacons are small strings of code that provide a method for delivering a graphic image on a webpage for the purpose of transferring data, such as the IP address of the computer that downloaded the page on which the web beacon appears, the URL of the page on which the web beacon appears, the time the page containing the web beacon was viewed, the type of browser that fetched the web beacon, and the identification number of any cookie on the computer previously placed by that server. We may also integrate SDKs into our applications to perform similar functions as cookies and web beacons. For example, SDKs may collect technical and usage information such as mobile device identifiers and your interactions with our site and other mobile apps.

We may use cookies and other technologies to help recognize your browser or device, maintain your preferences, provide certain site features, and collect Information about interactions with our site, our content, and our communications. For example, when corresponding with you via HTML-capable email, web beacons and other technologies let us know about your activity, including whether you received and opened our email, clicked through a link, or otherwise interacted with our content, and this information may be associated with Information previously collected.

We may also use cookies and other technologies (i) to provide, develop, maintain, personalize, protect, and improve our site, apps, products, programs, and services and to operate our business, (ii) to perform analytics, including to analyze and report on usage and performance of our site and marketing materials, (iii) to protect against, identify, and prevent fraud and other unlawful activity, (iv) to create aggregate data about groups or categories of our users, (v) to synchronize users across devices, affiliates, business partners, and select third parties, and (vi) for us and our affiliates, business partners, and select third parties to target, offer, market, or advertise products, programs, or services. Cookies and other technologies also facilitate, manage, and measure the performance of advertisements displayed on or delivered by or through us and/or other networks or sites.

By visiting our site, strictly necessary cookies may be placed on your device to enable core site functionality. All other cookies and tracking technologies are subject to your preferences and are only deployed after you provide affirmative consent, where required by law.

Consent to Use of Cookies and Tracking Technologies

We use a consent management platform that allows you to control the use of non-essential cookies and tracking technologies on our websites.

Except for cookies and technologies that are strictly necessary to operate the website (such as security, fraud prevention, and basic functionality), we do not deploy analytics, advertising, marketing, or similar tracking technologies on your device unless and until you provide your affirmative consent through our cookie banner or preference center.

You may update your preferences at any time by clicking the "Cookie Preferences" link in the footer of our websites.

We do not rely on implied consent, pre-checked boxes, passive browsing, or continued use of the website as consent for non-essential tracking technologies.

Managing cookies and other technologies

Cookies can either be persistent (i.e., they remain on your computer until you delete them) or temporary (i.e., they last only until you close your browser). Check your browser settings to learn how to delete cookies.

You may adjust your browser to reject cookies from us or from any other website. Controlling cookies via browser controls may not limit our use of other technologies. Please consult your browser's settings for more information. However, blocking cookies or similar technology might prevent you from accessing some of our content or site features.

Our site may use locally stored objects ("LSOs") to provide certain content and a better user experience. Adobe's Flash player and similar applications use this technology to remember settings, preferences, and usage similar to browser cookies. Flash cookies are not managed through your web browser, but you can access your Flash management tools by visiting Adobe's website. Your browser may also offer other tools to delete or reject other LSOs; please check your browser's settings or help menu for more information.

Some portion of our site may use Google Analytics to analyze traffic. You can find out more information about Google Analytics cookies by visiting Google's developer documentation. To opt out of Google Analytics relating to your use of our site, you can download and install Google's browser add-on for Google Analytics opt-out.

Children

Our Services are intended for adults. We do not knowingly collect personal information from anyone under 18, and the Telehealth Program is available only to adults. If you believe a minor has provided us with personal information, contact us at privacy@bookpinch.com and we will delete it.

California Privacy Rights
